Yet it is the Court's sworn duty to uphold the Constitution in all disputed matters. And the Constitution is very specific about its eligibility requirements for certain offices.

So, if not the Court, then who?

Any judge who ordered the kenyan to produce his birth certificate would be within his jurisdiction (and a hero to be remembered when the LSD's are gone and an opening occurs on a higher bench!). The usurper could appeal, but he would still need to produce that birth certificate to prevail.

Even if the judge is somehow wrong; he will have done the right thing by putting the matter to rest once and for all and declaring the Constitution will be upheld at all costs.
