wouldn't do the white smoke TSB

Went to my local dealer to get the upgrade on the TSB for the white smoke/ fuel mileage/ overhead calibration. They wouldn't do unless it had the white smoke symptoms saying it was considered service and opening them up to the "lemon law". They are pretty tough on the dealers here.I just wanted it to increase my gas mileage, plus the overhead is off by 1-3 mpg . He asked why I knew so much and I told I subscribe to TDR and recommended that they should so they wouldn't have to reinvent the wheel. Has anybody else had this problem in Ca. ?
