NY diesel cars??

Has anyone heard if or why there are no new diesel cars in new york? I was looking at the diesel jetta info and it is available in other states ( maybe not commiefornia). How could I get one in state legally? Or do I need to put a 4BTA in an old mercedes diesel? Info would help. Thanx
