TDR Website's Terms and Conditions
of Participation

Welcome to the Turbo Diesel Register (TDR) Website!
We trust you will find the
site both informative and fun, but first things first: By using our
website, you are agreeing to the following terms and conditions. If you do not wish to comply with
these terms and conditions, you shouldn't request posting privileges on the
TDR's Website. Please note that we reserve the
right to change these guidelines at any time, and your continued use of
the Website indicates that you agree to comply with any new or modified
guidelines. So remember to review the TDR's posting guidelines from time to time. All
website guidelines apply to posting in any public area of the website as
well as sending eletronic communications via Private Message or email forwarding.
1. Username and Access (please read this guideline carefully).
Subscribers may select a username of choice (all usernames will be screened for
appropriateness - no profanity or vulgarity, etc.) Each subscriber's last name
(as it appears on his/her TDR subscription) will be included in his/her
profile.
Last Names: We will allow
you to opt out of having your last name displayed on your profile. Instead it
will read, "Name withheld by user request". If you choose to be an anonymous
user, you WILL be held to a higher standard regarding the website guidelines
than those that do not. Things that are borderline on the guidelines that we
may let slide with other users, we will not with anonymous users. The following
will apply:
1. Users who withhold the publishing of
their last names cannot change his or her username under ANY situation (NO
exceptions).
2. Users who withhold the publishing of their last names
will be held to a "zero tolerance" policy relative to our website guidelines -
no warnings, strike 1 2 3, etc.
3. Commercial users (those we know are
affiliated with a related Commercial enterprise) cannot exercise this option
under any circumstance.
If you wish to utilize this option please email the TDR
Administrator at rpatton@ix.netcom.com with your request.
Signatures: Signatures will
only show up on the first post a user makes within a specific thread. To
minimize the incidence of solicitation on the TDR Discussion Forums, signatures
may not contain any type of solicitation (i.e. Truck for Sale, Best
Price on Any Autometer Gauge, Call Me For Price Quote, etc.). Any signature
containing information deemed solicitation by a Moderator will be edited out
without prior warning. If a user replaces the edited signature, their access to
edit their signature will be terminated without warning.
Avatars: Custom avatars are allowed however keep in mind that:
1. Avatars must be suitable for general audiences in terms of sex, violence, and profanity. In other words, if it would be inappropriate for your mother or your child to view in a public forum, it will be deemed inappropriate.
2. Anything considered inappropriate by ny Moderator will be deleted and that TDR Member will not be able to post avatars ever again in the history of the website. No kidding.
Vendor Note: Each active
vendor/commercial subscriber (account) should have his or her business name
incorporated into his or her signature block. It will also be added, by a TDR
Staff Member, just below your username. You are encouraged to include your
business telephone number. And you may add a link to your website by clicking
on your business name. No other solicitation in any form will be allowed
within a signature. Any signature containing information deemed
solicitation by a Moderator will be edited out without prior warning. If a user
replaces the edited signature, their access to edit their signature will be
terminated without warning.
By requesting posting privileges on
the TDR’s Website, you certify that all information you provide during the
registration process is accurate.
2. Conduct. The TDR encourages
lively and informative discussion among Discussion Forum participants. But keep
it clean and productive. Do not use or allow others to use your subscription
to:
2.1 Repeatedly post any material that the
moderators feel is antagonistic to others or instigates non-productive conflict
between users as well as vendors.
2.2. Post any material or comment that is
considered to be "baiting" others into an unproductive conflict online.
According to Webster's, baiting is: 1.) to place a lure or trap; 2.) to entice,
especially by trickery or strategy; 3.) to attack or torment, especially with
persistent insults, criticism, or ridicule. Baiting is considered to be any
post that intentionally badgers, heckles, or leads another user(s) into an
antagonistic discussion.
2.3. Post any form of solicitation on any
Discussion Forum. Discussion of ongoing Vendor Promotions and Group Purchases
may be allowed depending upon the objective of the thread. Direct promotion of
any Vendor Promotion or Group Purchase will be removed.
2.4. Post or transmit any material that is mean-spirited,
abusive, obscene, hateful, fraudulent, threatening, vulgar, harassing,
profane or defamatory. The use of symbols or characters to mask profanity
and expletives is prohibited and undermines the spirit of these guidelines;
2.5. Post, transmit or link to sexually
explicit material;
2.6. Post or transmit any material that
you don’t have authorization to transmit under the law (copyrighted
material);
2.7. Intentionally violate any applicable
law or regulation;
2.8. Knowingly post (or threaten to post)
or transmit (or threaten to transmit) any file that contains computer viruses,
corrupt files, or any other contaminating or destructive features that may
damage computer equipment.
2.9. Moderators may delete any post in
violation of these guidelines.
2.10 Occasional recommendations of vendors
by users is encouraged. However excessive promotion of vendors (cheerleading)
on the forums is discouraged and may be subject to removal.
2.11 Post any information regarding a
lawsuit or litigation (past, pending, or future). Any such post will be
immediately removed from the TDR Discussion Forums without notice.
3. Three Strikes You're Out. On a Discussion Forum of
this size, responsibility and accountability are important. No one wants to log
onto a chaotic, mean-spirited forum. The consequences of non-compliance are
outlined below:
3.1. One violation of the guidelines will
usually warrant an e-mail notice to kindly stop/correct the behavior.
3.2. Two violations will usually warrant a thirty-day suspension of posting
privileges.
3.3. Three violations and you will be issued a refund of
your remaining TDR subscription and your posting privileges will be immediately
revoked.
Please note that we reserve the right to skip steps if we feel
the violation so warrants. The TDR reserves the right to remove any
inappropriate post or terminate your posting privileges to the Discussion
Forums at any time, with or without prior notice.
4. Discussion Forums. The TDR Website Discussion Forum
is designed to help owners solicit input from others on the proper maintenance
and operation of their truck. Most truck enthusiasts want detailed information,
thorough analysis, entertaining reading, and friendly (accurate) guidance. We
recognize that while we have a lot of truck information in this forum, people
sometimes post replies that are misleading, deceptive, or downright wrong. They
may do this unintentionally or, sad to say, intentionally. Let's change the
timeworn axiom to read, "Let the reader beware." Use good common sense.
Remember, we do not have the staff to mediate or "police" all of the
information that is posted. Analyze thoroughly before taking any advice
offered. The fundamental concept is that you should not rely solely upon any
information or opinions you read. Rather, you should use what you read as a
starting point for doing independent research on products and maintenance
techniques.
4.1. Keep your posts relevant to the topic
at hand.
4.2. Post your topic in the correct forum. Moderators will
move posts that are incorrectly located.
4.3. Moderators may delete
posted items offered for sale within any Discussion Forum.
5. Vendor Participation: Vendor input and commentary is
welcomed in our Discussion Forums, however, direct solicitation is not. Vendors
have proven to provide insightful conversation and commentary. Demonstrate
professionalism in all post to the TDR Discussion Forums. The following will be
strictly enforced:
5.1. The TDR Discussion Forums are not an
appropriate forum for emotionally charged discussion between manufacturers,
distributors, dealers, shops and/or users. These forums are intended to be
technical resources for members interested in learning more about the proper
care and maintenance of their trucks. All Vendors will refrain from making
direct, emotionally charged, posts to and/or about competitors. All Vendor
posts must be civil and technically oriented. If Vendors wish to compare
products with competitors, use generic references (i.e. oiled element air
filter; as opposed to Amsoil, AFE, etc.).
5.2. No direct solicitation
pricing discussions are allowed on the TDR Discussion Forums. The discussion of
prices is best left off-line in a private e-mail to those with interest as
noted in the appropriate area of the Classified Advertisements. Why? Because
many people who visit our Website do not want to pay to read solicitations and
sales pitches in our technical Discussion Forums.
5.3. Vendor
participants must have their business name incorporated into their signature
block. Vendors may include their business telephone number within their Profile
so that it is available to other TDR website users.
6. Vendor
Promotions. Commercial solicitation is not allowed in any Discussion
Forum. They should be posted within the Classified Advertisements
only.
Vendor Promotions (defined as a TDR
Advertiser of Record offering a special to the TDR Members): Any
advertiser of record wishing to post press releases or general TDR promotions
may do so within the Vendor Promotion/Group Purchase area of the Classified
Advertisements in accordance with the following
guidelines:
6.1. Vendor promotions should clearly
state a start date and an end date. Its terms must be specific. Any Vendor
Promotion that does not include detailed contact information, a product listing
and discounted pricing details will be removed.
6.2. No group purchase
or vendor promotion will imply that it has the TDR’s endorsement nor will
it imply any affiliation with the TDR.
6.3. Vendor promotions will be
scheduled to run for 30 days. Advertisers of record can renew their promotion
in subsequent 30-day intervals, if warranted.
6.4. Only TDR Advertisers
of Record will be allowed to post Vendor Promotions on the TDR Website. All
other Vendors interested in offering a special to TDR Members may contact the
Turbo Diesel Register offices to discuss the best way to reach the TDR
Members.
6.5 A TDR Staff Member will post a notice in the TDR Group
Purchase and Vendor Promotion Forum outlining the specific terms of the Vendor
Promotion.
6.6 The TDR reserves the right
to limit any Vendor to the number of promotions offered per year. This will be
done where it is determined that a Vendor is using the Turbo Diesel Register
as nothing more than a billboard.
6.7 The TDR does not allow Group Purchases
effective July, 2008. There have been two Group Purchases where vendors failed to fulfill
their commitments to TDR Members. This has required we discontinue Group Purchases on the TDR
Website.
A Word of Caution: Remember the best
deal is not always the cheapest deal. Considerations: If something sounds too
good to be true, then it probably is. A good strategy is to establish a
relationship with a vendor(s) you trust. If you see a great vendor
gotta-have-it, continue to work with the vendor that has previously earned your
trust rather than chase after the Johnny-come-lately. Likely your established
vendor of choice will bend to meet a competitive situation. Good suppliers and
good relations are worth the courtesy of a phone call and your continued
purchasing support. Good luck. It's a free-for-all jungle out
there.
7. Links Information. The
Turbo Diesel Register does not guarantee the reliability or completeness of any
information provided in the Discussion Forum or in any link appearing on our
site. Links are not endorsements of any products or services in such sites, and
no information in such site has been endorsed or approved by the
TDR.
8. Educate, Don't Irritate.
Generally, nobody enjoys posts that offer little or no information, contains
emotion at the expense of reason, or attacks another party. And remember, it is
entirely possible to agree to disagree with others . . . respectfully.
Diplomacy, discretion and common sense should be your guides. A click to the
private e-mail icon and an off-line discussion is suggested to resolve
difference.
9. Proper Punctuation Pleases the
Public. Remember that TYPING IN ALL CAPITAL LETTERS is akin to
shouting. Also, the excessive use of exclamation marks and other punctuation
can make your posting difficult to read, not to mention irritating. Remember,
misspelled words reflect poorly on you.
10. It Is the WWW (Don't Forget, The
World Is Watching . . .). This one is simple. Be aware that anything
you post on the TDR Website - or anywhere on the World Wide Web for that matter
- may be read by the rest of the world. Keep your pants up. We do not have the
staff to change user names to protect you from something you posted without
serious consideration first.
11. The Fine Print Section.
11.1. Respect Copyrighted Material. The
material contained on this Website is copyrighted and is protected by US and
international copyright laws. By material we mean any information or other
material and services found on our Website or in our magazine. This includes,
but is not limited to, discussion forums, articles, graphics, logos, and
artwork. Subscribers may summarize our material or other writings and post an
occasional sentence or two, but not the entire article. Repeat violators of
this guideline are subject to account termination without notice. Note: by
posting to the TDR Website, you agree that the Turbo Diesel Register has an
unlimited license to republish any material or pictures you post on our
Website.
11.2. Keep It To Yourself (Passwords). The TDR reserves the
right to remove any inappropriate post or terminate your posting privileges to
the Discussion Boards at any time, with or without prior notice. Because you
are responsible for all statements made and acts that occur through the use of
your user name and
password, you should take great care to protect your
password.
11.3. Disclaimer of Warranties and Liabilities. The Turbo
Diesel Register is not affiliated with nor does it represent DaimlerChrysler or
Cummins Engine Company, nor any of their subsidiaries. Throughout our Website
some words, model names and designations are used for the purpose of
identification. Such names are the property of the trademark holder.
Final Comments. The TDR
provides a wide range of information, commentary and entertainment. Although we
strive hard to provide the best possible information at all times, we make no
guarantees that our content will be delivered in an uninterrupted, timely,
secure or error-free manner. In simplest terms, you agree that under no
circumstances will the TDR be liable for direct, indirect, incidental, or any
other type of damages resulting from your use or downloading of any material
from the TDR Website.
Remember: All material provided on
the TDR Website is to be used on an "as is" basis; and remember, we're not
perfect. Opinions expressed by the members do not necessarily reflect the
opinions of the Turbo Diesel Register, DaimlerChrysler Corporation or the
Cummins Engine Company.
The Turbo Diesel Register assumes no liability
for direct, indirect, punitive, consequential, special or incidental damages,
accident, injury, loss of property, income or life due to use or misuse of
comments, suggestions, procedures, modifications, enhancements, repairs or
information presented on the Website.
Any action related to the terms
and conditions, including issues of trademark and copyright, will be governed
by the laws and statues of the State of Georgia and controlling US federal law
without regard to the conflicts of laws principles thereof. By your use of this
site, you agree and hereby submit to the exclusive jurisdiction and venue of
the courts of the State of Georgia or federal court in Fulton County, Georgia
with respect to any legal proceeding or action. If you do not agree to these
terms and conditions, do not view, download or visit the Website.
The
use of this site, and the terms and conditions for our providing information,
is governed by our TDR Website Posting Guidelines. By using this site, you
acknowledge that you have read the TDR Website Posting Guidelines and that you
